Welcome to My Learning Mate. By accessing or using our website, mobile and/or other online services (the “Platform”) to connect teachers and learners globally, you agree to these Terms & Conditions (“Terms”). If you do not agree with these Terms, please do not use the Platform.
1. Definitions
- “We”, “Us”, “Our” means My Learning Mate (and its affiliates).
- “You” or “User” means any individual or entity using the Platform as a Teacher, Student, Parent/Guardian, or otherwise.
- “Teacher” means a user who delivers lessons via the Platform.
- “Student” means a user who receives lessons via the Platform.
- “Services” means the tutoring, skill-based, group or one-on-one sessions offered via the Platform.
- “Account” means the user account you create to access the Platform.
2. Eligibility & Account Registration
- You must be at least 18 years old (or of legal age in your country) to register as a Teacher or Student user. If you are under the legal age, use of the Platform requires prior consent of a parent or legal guardian.
- You agree to provide accurate, complete registration information, and to keep it up-to-date.
- You are responsible for maintaining the confidentiality of your login credentials and for any activity under your account.
3. Services Description & Scope
- The Platform acts to connect Teachers and Students; we facilitate access and scheduling and may provide value-added platform services.
- Teachers are independent contractors (unless otherwise stated) and not employees of My Learning Mate.
- We make no guarantee of specific learning outcomes, grades or results from use of the Services.
- All Users agree to abide by any policies, codes of conduct, or guidelines we publish from time to time.
4. Payments, Fees & Refunds
- Students (or Parents/Guardians) will pay fees for Sessions as displayed at the time of booking. Payment must be processed via the Payment Methods provided.
- Teachers will be paid according to the schedule and terms we provide, less any applicable platform fees or commissions (if applicable).
- Refunds, cancellations and rescheduling policies will be published separately; those policies form part of these Terms.
- If you reside in Australia, the Australian Consumer Law applies to consumer-level transactions, including guarantees and refund rights. Sprint Law+1

- If you reside in the USA, regional consumer protection laws may apply; for California residents, for example, additional rights may apply under the CCPA/CPRA.
- If you reside in India, applicable contract and consumer protection laws apply.
5. Age of Users & Parental Consent
- If the Student is a minor (under the age of majority in their jurisdiction), a Parent or Legal Guardian must create or supervise the Account.
- Teachers or Students working with minors must comply with local laws regarding child protection (for example, “Working With Children” checks in Australia). Sprint Law
- Users must not misrepresent their age or identity.
6. Data Protection & Privacy
- We will collect, process, and store personal data in accordance with our Privacy Policy, which forms part of these Terms.

- For US users, state and federal privacy laws may apply (e.g., CCPA in California).

- You represent and warrant that any data you provide is accurate, and you consent to our processing of that data.
- We may store, monitor or record sessions (audio or video) for quality assurance, dispute resolution or compliance purposes.
7. User Conduct & Acceptable Use
- You agree to use the Platform only for lawful purposes and in compliance with third-party rights, laws and regulations.
- Prohibited conduct includes (but is not limited to): harassing or abusive behaviour, unlawful discrimination, uploading or sharing illegal or infringing content, circumventing payment or booking mechanisms, direct contact for off-Platform services outside the Platform’s payment/billing system (unless permitted by us).
- Teachers must deliver sessions in a professional manner. Students and teachers must respect each other’s rights, privacy and dignity.
8. Intellectual Property
- Unless otherwise agreed, all content on the Platform (including software, site content, graphics, trademarks, etc.) is owned or licensed by My Learning Mate.
- Teachers grant us a worldwide, non-exclusive, royalty-free license to use content created in connection with the Platform (for example session recordings, student progress summaries, and promotional use) as set out in our Content/Usage policy.
- You may not reproduce, distribute, modify or create derivative works from the Platform content without our prior written permission.
9. Disclaimers & Limitation of Liability
- To the fullest extent permitted by law, My Learning Mate provides the Platform and Services “as is” and without warranties of any kind.
- We do not guarantee specific academic results, and we are not responsible for how you apply the knowledge obtained.
- In jurisdictions where legal liability cannot be excluded or limited, those provisions will apply regardless of this clause (for example certain Australian consumer law rights). Online Science Tutoring
- Our total liability to you (in contract, tort or otherwise) shall be limited to the amount paid by you for the relevant Services (or such other cap as required under local law).
- We are not responsible for technical failures, internet connectivity issues, or third-party services used in connection with the Platform.
10. Governing Law & Dispute Resolution
- Unless otherwise provided, these Terms are governed by the laws of the country where you reside or where the contract is formed, subject to mandatory rights under local laws.
- For Students/Teachers in multiple jurisdictions, disputes may be resolved via mediation/arbitration or court proceedings as appropriate under local law.

11. Changes to Terms
- We may revise these Terms from time to time; the updated Terms will be posted on the Platform and will take effect on the date specified. Your continued use of the Platform constitutes acceptance of the revised Terms.
12. Termination
- We may suspend or terminate your access to the Platform at our discretion (for example for breach of these Terms).
- You may also close your Account at any time in accordance with cancellation guidelines.
- Termination does not affect rights and obligations accrued prior to termination.
13. Regional Specific Addenda
13.1 United Kingdom
- UK users remain protected under UK consumer protection laws, including the Consumer Rights Act 2015, even if the Terms specify a different governing law.
- UK Teachers should comply with UK education/safeguarding legislation (e.g., safeguarding children, DBS checks).
13.2 United States
- For US users, you must comply with federal and state laws including, for minors, the Children’s Online Privacy Protection Act (COPPA) (if collecting data from children under 13).
- Taxes: Individual Teachers are responsible for their own tax obligations (e.g., IRS, state taxation).
13.3 Australia
- Australian users are protected under the Australian Consumer Law (ACL) and the Privacy Act 1988. Teachers delivering tutoring services may need relevant state/territory “Working With Children” checks. Sprint Law
13.4 India
- Indian users must comply with the Information Technology Act, Rules, and applicable education/consumer protection regulations.
- Teachers delivering services in India should ensure compliance with applicable taxation (GST), professional accreditation (if required) and labour laws.
14. General Provisions
- Severability: If any provision of these Terms is held invalid or unenforceable in a jurisdiction, the remainder shall remain in full force and effect.
- Assignment: You may not assign your rights or obligations under these Terms without our prior written consent. We may assign without notice.
- Notices: Notices may be given via email to the address you provide or via notices on the Platform; they are deemed given when sent.
- Entire Agreement: These Terms (together with our Privacy Policy and any other policies referenced herein) constitute the entire agreement between You and Us regarding the subject matter hereof, and supersede all prior understandings.
